This paper highlights methods — other than legislative and regulatory directives — through which decision-makers may use law and the legal system to facilitate the systems-wide change that the IOM calls for.

ObjectiveTo examine measurement agreement between a vocabulary test that is administered in the standardized manner and a version that is administered with a brain-computer interface.MethodThe sample was comprised of 21 participants, ages 9–27, mean age 16.7 years, 61.9% male, including 10 with congenital spastic cerebral palsy, and 11 comparison peers. Participants completed both standard and BCI-facilitated alternate versions of the Peabody Picture Vocabulary Test - 4. The BCI-facilitated PPVT-4 uses items identical to the unmodified PPVT-4, but each quadrant forced-choice item (...) is presented on a computer screen for use with the BCI.ResultsMeasurement agreement between instruments was excellent, including an intra-class correlation coefficient of 0.98, and Bland-Altman plots and tests indicating adequate limits of agreement and no systematic test version bias. The mean standard score difference between test versions was 2.0 points.ConclusionThese results demonstrate that BCI-facilitated quadrant forced-choice vocabulary testing has the potential to measure aspects of language without requiring any overt physical or communicative response. Thus, it may be possible to identify the language capabilities and needs of many individuals who have not had access to standardized clinical and research instruments. (shrink)

Between 1905 and 1913, French physicist Jean Perrin's experiments on Brownian motion ostensibly put a definitive end to the long debate regarding the real existence of molecules, proving the atomic theory of matter. While Perrin's results had a significant impact at the time, later examination of his experiments questioned whether he really gained experimental access to the molecular realm. The experiments were successful in determining the mean kinetic energy of the granules of Brownian motion; however, the values for molecular magnitudes (...) Perrin inferred from them simply presupposed that the granule mean kinetic energy was the same as the mean molecular kinetic energy in the fluid in which the granules move. This stipulation became increasingly questionable in the years between 1908 and 1913, as significantly lower values for these magnitudes were obtained from other experimental results like alpha-particle emissions, ionization, and Planck's blackbody radiation equation. In this case study in the history and philosophy of science, George E. Smith and Raghav Seth here argue that despite doubts, Perrin's measurements were nevertheless exemplars of theory-mediated measurement-the practice of obtaining values for an inaccessible quantity by inferring them from an accessible proxy via theoretical relationships between them. They argue that it was actually Perrin more than any of his contemporaries who championed this approach during the years in question. The practice of theory-mediated measurement in physics had a long history before 1900, but the concerted efforts of Perrin, Rutherford, Millikan, Planck, and their colleagues led to the central role this form of evidence has had in microphysical research ever since. Seth and Smith's study thus replaces an untenable legend with an account that is not only tenable, but more instructive about what the evidence did and did not show. (shrink)

This article attempts to answer a question that many dancers and non-dancers may have. What is dance according to the media? Furthermore, how does the written word portray dance in the media? To answer these ques-tions, this research focuses on the role that the discourse of dance in media plays in the public sphere’s knowledge construction of dance. This is impor-tant to study because the public sphere’s meaning of dance will determine whether dance education is promoted or banned in schools (...) and in society. The aim of this paper is to contribute to the existing literature of dance in the media. One limitation of this contribution is that the research uses only newspaper articles as a source of analysis. Future research should include an analysis of visual and audio clips of dance as portrayed in the media. (shrink)

Brain-computer interfaces (BCIs) have been successfully used by adults, but little information is available on BCI use by children, especially children with severe multiple impairments who may need technology to facilitate communication. Here we discuss the challenges of using non-invasive BCI with children, especially children who do not have another established method of communication with unfamiliar partners. Strategies to manage these challenges require consideration of multiple factors related to accessibility, cognition, and participation. These factors include decisions regarding where (home, clinic, (...) or lab) participation will take place, the number of sessions involved, and the degree of participation necessary for success. A strategic approach to addressing the unique challenges inherent in BCI use by children with disabilities will increase the potential for successful BCI calibration and adoption of BCI as a valuable access method for children with the most significant impairments in movement and communication. Biological ontologies are used to organize, curate, and interpret the vast quantities of data arising from biological experiments. While this works well when using a single ontology, integrating multiple ontologies can be problematic, as they are developed independently, which can lead to incompatibilities. The Open Biological and Biomedical Ontologies Foundry was created to address this by facilitating the development, harmonization, application, and sharing of ontologies, guided by a set of overarching principles. One challenge in reaching these goals was that the (...) OBO principles were not originally encoded in a precise fashion, and interpretation was subjective. Here we show how we have addressed this by formally encoding the OBO principles as operational rules and implementing a suite of automated validation checks and a dashboard for objectively evaluating each ontology’s compliance with each principle. This entailed a substantial effort to curate metadata across all ontologies and to coordinate with individual stakeholders. We have applied these checks across the full OBO suite of ontologies, revealing areas where individual ontologies require changes to conform to our principles. Our work demonstrates how a sizable federated community can be organized and evaluated on objective criteria that help improve overall quality and interoperability, which is vital for the sustenance of the OBO project and towards the overall goals of making data FAIR. When the COVID-19 surge hit New York City hospitals, the Division of Medical Ethics at Weill Cornell Medical College, and our affiliated ethics consultation services, faced waves of ethical issues sweeping forward with intensity and urgency. In this article, we describe our experience over an eight-week period (16 March through 10 May 2020), and describe three types of services: clinical ethics consultation (CEC); service practice communications/interventions (SPCI); and organizational ethics advisement (OEA). We tell this narrative through the prism of time, (...) describing the evolution of ethical issues and trends as the pandemic unfolded. We delineate three phases: anticipation and preparation, crisis management, and reflection and adjustment. The first phase focused predominantly on ways to address impending resource shortages and to plan for remote ethics consultation, and CECs focused on code status discussions with surrogates. The second phase was characterized by the dramatic convergence of a rapid increase in the number of critically ill patients, a growing scarcity of resources, and the reassignment/ redeployment of staff outside their specialty areas. The third phase was characterized by the recognition that while the worst of the crisis was waning, its medium- and long-term consequences continued to pose immense challenges. We note that there were times during the crisis that serving in the role of clinical ethics consultant created a sense of dis-ease as novel as the coronavirus itself. In retrospect we learned that our activities far exceeded the familiar terrain of clinical ethics consultation and extended into other spheres of organizational life in novel ways that were unanticipated before this pandemic. To that end, we defined and categorized a middle level of ethics consultation, which we have termed service practice communication intervention (SPCI). This is an underappreciated dimension of the work that ethics consult services are capable of in times of crisis. We believe that the pandemic has revealed the many enduring ways that ethics consultation services can more robustly contribute to the ethical life of their institutions moving forward. (shrink)

Philosophers, psychologists, economists and other social scientists continue to debate the nature of human well-being. We argue that this debate centers around five main conceptualizations of well-being: hedonic well-being, life satisfaction, desire fulfillment, eudaimonia, and non-eudaimonic objective-list well-being. Each type of well-being is conceptually different, but are they empirically distinguishable? To address this question, we first developed and validated a measure of desire fulfillment, as no measure existed, and then examined associations between this new measure and several other well-being measures. (...) In addition, we explored associations among all five types of well-being. We found high correlations among all measures of well-being, but generally correlations did not approach unity, even when correcting for unreliability. Furthermore, correlations between well-being and related constructs (e.g., demographics, personality) depended on the type of well-being measured. We conclude that empirical findings based on one type of well-being measure may not generalize to all types of well-being. (shrink)

This paper examines the importance of artist names and artistic identity, especially as expressed in artist signatures, to the interpretation of ancient Greek pottery. Attention is focused on a calyx krater signed ΣϒPIΣKOΣ EΓPΦΣEN [sic], and it is argued that the non-Greek ethnikon used as artist name encourages a non-Athenian reading of the iconography. The painted labels for all six figures on this vase, together with parallels from other Athenian red-figure vases—including others from the Syriskos workshop—all suggest the presentation of (...) an alternative, un-Athenian world view. Okeanos, Dionysos, and Epaphos are read as representing faraway lands at the edges of the Ge Panteleia, or “entire earth,” while the central figure of Themis, Greek personification of divine right, is depicted pouring a libation to Balos, the Hellenized form of the Syrian supreme god Baal, thereby recognizing his status as a supreme deity. Other overtly political messages have been read elsewhere in the oeuvre of the Syriskos Workshop, where it seems that at least two distinct artistic identities were at play—the explicitly foreign “little Syrian,” and the more conventional Pistoxenos, or “trustworthy foreigner.” When explicitly signed on vessels, these artistic identities necessarily sway interpretation, whereas on the many unsigned pieces, the viewer is left to consider which identity is at play. Light as a subject of thought has proved impossible to deal with holistically. Light is intrinsic to the farthest reaches of physics, psychology, philosophy, art, etc. The conceptual structures to deal with light have been quite complex, often resulting in contradictions and paradoxes, e.g., light is conceived in terms of space and time, themselves functions of light. Knowing light appears to leave a remainder. Light cannot be wholly captured by thought; the experience of light does not reduce to knowledge of (...) light. Perhaps more than any other phenomenon, light poses problems of distinguishing between the physical object and the object in mind. The record of thought about light shows that distinguishing between subjective and objective aspects of light has been notoriously difficult and a recurrent effort, apparently necessary towards understanding light. The author argues that light demands the reconciliation of concept and experience, objective and subjective aspects; dividing these limits understanding of light. In developing a research method that combines both the semantics and architectonics of light, the author draws from his original Light Dance art form towards a holistic understanding of light that reflects mindmatter continuity. The present article proposes an integration between cultural psychology and developmental science. Such an integration would draw on the cultural-psychology principle of culture-psyche interactions, as well as on the developmental-science principle of person↔︎context relations. Our proposed integration centers on acculturation, which is inherently both cultural and developmental. Specifically, we propose that acculturation is governed by specific transactions between the individual and the cultural context, and that different types of international migrants (e.g., legal immigrants, undocumented immigrants, refugees, asylum seekers, crisis migrants) (...) encounter quite different culture-psyche interactions and person↔︎context relations. We outline the ways in which various acculturation-related phenomena, such as acculturation operating at macro-level versus micro-level time scales, can be viewed through cultural and developmental lenses. The article concludes with future directions in research on acculturation as an intersection of cultural and developmental processes. (shrink)

I don’t propose to harp on the question of whether MacFarlane has the data right. Let us just assume, for the sake of argument, that he does. Let us further assume that his interpretation of the data is correct—i.e., that these judgments are assessments of the the whole clause and not simply of the prejacent. Granting all this—maybe a lot—we need a semantics for epistemic modals that will make sense of the judgments in this case, and in relevantly similar cases. (...) Mac- Farlane argues that contextualism about epistemic modals cannot make sense of the judgments. His central worry is that it can only get the truth-value judgments of speakers right by making the truth-conditions of epistemic modal claims outrageously strong—too strong to be assertable in cases where they are, in fact, assertable. We might call it the contextualist’s dilemma: either our semantics systematically fails to capture the truth-value judgments that people actually make, or it captures these judgments but turns users of epistemic modal sentences into irrational asserters. In this review essay, I offer a summary of Brian E. Butler’s The Democratic Constitution: Experimentalism and Interpretation. Butler’s democratic experimentalism offers the thesis that democracy needs to be protected democratically rather than by relying on the judicial supremacy over constitutional interpretation by the Supreme Court. Butler illustrates what democratic experimentalism looks like through a close reading of key cases showing the virtues of an on-going, open-ended, empirical, fallibilist, and collaborative approach to constitutional interpretation against rival formalist and exclusionary theories. (...) Butler relies on Richard Posner’s iconoclastic empirical approach to adjudication in advancing his thesis. However, Posner is skeptical of the Deweyan democracy Butler deploys to illustrate the democratic constitution. Further, Posner dismisses the philosophical pragmatism of Peirce and Dewey that Butler uses to ground his theory. Because of Butler’s reliance on Posner’s judicial practice and his side-stepping of Posner’s views on democracy and philosophical pragmatism, I ask how Butler’s proposal stands in relation to the ways it departs from Posner’s theory, if not his practice. From its beginnings, some of German film's most prominent genres and directors have focused on the natural world and its transformations by humans. Heimat films, "city symphonies," mountain films, and rubble films all blend the boundary between landscape documentary and fiction film. Yet German film studies has been slow to adopt an environmental focus, concentrating (understandably) on its subject matter's political implications. This book reveals critical connections between German film, sociopolitical context, and environment, showing it to have been a creative (...) catalyst for the social and ecological transformation of the Anthropocene. The book first considers the interplay between German film and environmental history in films and discourses of Heimat. Weimar-era films such as E. A. Dupont's Die Geierwally (1921), Carl Ludwig Achaz-Duisberg's Sprengbagger 1010 (1929), and Phil Jützi's Hunger in Waldenburg (1929) document and create a forum for discussing environmental change. The book then looks at film as a visual archive of and catalyst for infrastructure development, focusing on Metropolis (Fritz Lang, 1927), the mountain films of Arnold Fanck, and the Berlin films Stadt der Millionen (Adolf Trotz, 1925), Berlin: Die Sinfonie der Grossstadt (Walter Ruttmann, 1927), and Menschen am Sonntag (1930). Nazi-era and postwar films are also examined. By exploring German film history alongside environmental history and theory, this book provides a case study of the power of film within processes of environmental transformation. (shrink)

This paper presents a version of neurophenomenology based on generative modelling techniques developed in computational neuroscience and biology. Our approach can be described as _computational phenomenology_ because it applies methods originally developed in computational modelling to provide a formal model of the descriptions of lived experience in the phenomenological tradition of philosophy (e.g., the work of Edmund Husserl, Maurice Merleau-Ponty, etc.). The first section presents a brief review of the overall project to naturalize phenomenology. The second section presents and evaluates (...) philosophical objections to that project and situates our version of computational phenomenology with respect to these projects. The third section reviews the generative modelling framework. The final section presents our approach in detail. We conclude by discussing how our approach differs from previous attempts to use generative modelling to help understand consciousness. In summary, we describe a version of computational phenomenology which uses generative modelling to construct a computational model of the inferential or interpretive processes that best explain this or that kind of lived experience. An object-based correspondence theory of truth holds that a truth-bearer is true whenever its truth conditions are met by objects and their properties. In order to develop such a view, the principal task is to explain how truth-bearers become endowed with their truth conditions. Modern versions of the correspondence theory see this project as the synthesis of two theoretical endeavours: basic metasemantics and compositional semantics. Basic metasemantics is the theory of how simple, meaningful items (e.g. names and concepts) are endowed (...) with their contributions to truth conditions, and compositional semantics is the theory of how the meanings of simple items compose to generate (among other things) the truth conditions of sentences. Understanding truth along these broad lines was once popular; it was first championed by Field (1972). However, the once-popular conception of its tasks included an over-ambitious view of basic metasemantics. It was thought that reference needed to be analyzed (or reduced a posteriori) in terms of more fundamental, non-semantic relations (e.g. causal relations, indication, or teleological relations, in the case of mental representation). Obstacles in providing such an analysis engendered skepticism towards this understanding of truth and eventually gave way to its deflationary competitors. This dissertation aims to defend the modern, object-based correspondence theory against its rivals—especially deflationism. Chapter one provides a historically-grounded overview of the theory. Chapter two identifies two points of contrast between the correspondence theorist and the deflationist: they employ different orders of explanation for the variety of semantic phenomena, and they (traditionally) take different attitudes towards the prospects of reduction. Situating the dialectic in this way allows me to develop a middle ground: a moderate version of inflationism that takes the inflationary explanatory structure and combines it with a non-reductive, pluralist approach to basic metasemantics. Chapter three expands on the details of this pluralist account of reference. Chapter four contrasts the view with another rival approach to basic metasemantics: metasemantic interpretationism. And finally, chapter five applies the theory to answer another question of broad philosophical interest: what role does our conception of truth play in inquiry about the world? (shrink)

Master Sun's _The Art of War_ is by no means the only ancient Chinese treatise on military affairs. One chapter in the _Huainanzi_, an important compendium of philosophy and political theory written in the second century B.C.E., synthesizes the entire corpus of military literature inherited from the Chinese classical era. Drawing on all major, existing military writings, as well as other lost sources, it assesses tactics and strategy, logistics, organization, and political economy, as well as cosmology and the fundamental morality (...) of warfare. This powerful work set out to become the last word on military matters, subsuming and replacing all preceding literature. Written under the sponsorship of Liu An, king of Huainan, the _Huainanzi_'s "military methods" emphasize the preservation of peace as the ultimate value to be served by the military, insisting that the army can be effectively and rightly used only when defending the sacred hereditary position of the emperor and his vassals. This position stands in stark contrast to that of _The Art of War_, which prioritizes the enrichment and empowerment of the state. Liu An's philosophy also argues that military success depends on the personal cultivation of the commander and that deception is not enough to secure victory. Only a commander with the exceptional qualities of insight and cognition, developed through a program of meditative practice and yogic refinement, can effectively control and interpret the strategic situation. Andrew Seth Meyer offers both a full translation of this text and an extensive analysis of its historical context. His thorough treatment relates Liu An's teachings to issues in Chinese philosophy, culture, religion, and history, helping to interpret their uncommon message. (shrink)

The text represents a remarkable synthesis of Daoist classics, such as the _Laozi_ and the _Zhuangzi_; works associated with the Confucian tradition, such as the _Changes_, the _Odes_, and the _Documents_; and a range of other foundational philosophical and literary works, from the _Mozi_ to the _Hanfeizi_. Social and personality psychology have been criticized for overreliance on potentially biased self-report variables. In well-being science, researchers have called for more “objective” physiological and cognitive measures to evaluate the efficacy of well-being-increasing interventions. This may now be possible with the recent rise of cost-effective, commercially-available wireless physiological recording devices and smartphone-based cognitive testing. We sought to determine whether cognitive and physiological measures, coupled with machine learning methods, could quantify the effects of positive interventions. The current 2-part study used a (...) college sample (N = 245) to contrast the cognitive (memory, attention, construal) and physiological (autonomic, electroencephalogram) effects of engaging in one of two randomly assigned writing activities (i.e., prosocial or “antisocial”). In the prosocial condition, participants described an interaction when they acted in a kind way, then described an interaction when they received kindness. In the “antisocial” condition, participants wrote instead about an interaction when they acted in an unkind way and received unkindness, respectively. Our study replicated previous research on the beneficial effects of recalling prosocial experiences as assessed by self-report. However, we did not detect an effect of the positive or negative activity intervention on either cognitive or physiological measures. More research is needed to investigate under what conditions cognitive and physiological measures may be applicable, but our findings lead us to conclude that they should not be unilaterally favored over the traditional self-report approach. We present a population density and moment-based description of the stochastic dynamics of domain $${\text{Ca}}^{2+}$$ -mediated inactivation of L-type $${\text{Ca}}^{2+}$$ channels. Our approach accounts for the effect of heterogeneity of local $${\text{Ca}}^{2+}$$ signals on whole cell $${\text{Ca}}^{2+}$$ currents; however, in contrast with prior work, e.g., Sherman et al. :985–995, 1990), we do not assume that $${\text{Ca}}^{2+}$$ domain formation and collapse are fast compared to channel gating. We demonstrate the population density and moment-based modeling approaches using a 12-state Markov chain model (...) of an L-type $${\text{Ca}}^{2+}$$ channel introduced by Greenstein and Winslow :2918–2945, 2002). Simulated whole cell voltage clamp responses yield an inactivation function for the whole cell $${\text{Ca}}^{2+}$$ current that agrees with the traditional approach when domain dynamics are fast. We analyze the voltage-dependence of $${\text{Ca}}^{2+}$$ inactivation that may occur via slow heterogeneous domain [ $${\text{Ca}}^{2+}$$ ]. Next, we find that when channel permeability is held constant, $${\text{Ca}}^{2+}$$ -mediated inactivation of L-type channels increases as the domain time constant increases, because a slow domain collapse rate leads to increased mean domain [ $${\text{Ca}}^{2+}$$ ] near open channels; conversely, when the maximum domain [ $${\text{Ca}}^{2+}$$ ] is held constant, inactivation decreases as the domain time constant increases. Comparison of simulation results using population densities and moment equations confirms the computational efficiency of the moment-based approach, and enables the validation of two distinct methods of truncating and closing the open system of moment equations. In general, a slow domain time constant requires higher order moment truncation for agreement between moment-based and population density simulations. (shrink)

Greenberger. Horne. Shimony, and Zeilinger gave a new version of the Bell theorem without using inequalities (probabilities). Mermin summarized it concisely; but Bohm and Hiley criticized Mermin's proof from contextualists' point of view. Using the branching space-time language, in this paper a proof will be given that is free of these difficulties. At the same time we will also clarify the limits of the validity of the theorem when it is taken as a proof that quantum mechanics is (...) not compatible with a deterministic world nor with a world that permits correlated space-related events without a common cause.
